Background of the case I applied to the HOA for approval to build a boundary wall. Approval was granted in October , and I paid the required fees. I relied on the estate manager to obtain neighbour consent (especially from house ), which was not properly followed through. Construction began, but was stopped by the HOA citing: Lack of written consent from house . A 5cm deviation from the approved plan. Withdrawal of consent by house (after approval was granted). CSOS Adjudication Outcome My application was dismissed. The adjudicator found the approval invalid due to missing consent and deviation. I was not given a formal opportunity to submit amended plans. The HOA is now pushing for demolition. The adjudicator made no order as to costs. Current Legal Action I have filed a Notice of Appeal and an Application for Condonation with the High Court. Grounds for appeal include: Procedural unfairness. Failure to allow amended plans. Consent withdrawal after approval. No formal documentation of withdrawal. HOA’s approval despite missing documentation. Good faith actions on my part. Urgency HOA is threatening demolition. A pending legal case exists against house to prove the timing of consent withdrawal. I need representation to stay demolition and proceed with the appeal.
I was dismissed and the commissioner found that the dismissal was unfair but was only awarded with 12 months salary and no reinstatement( which means I'll forfeit benefits like medical aid and bring paid on monthly basis a pensioner) sighting that I've reached the retirement age whereas according to policy our retirement age is 65 and I still have 4 years to be utilised in a work place.

I want to know how I can donate / sell 50%of the property ( not at current house value but for a minimal amount ) thereby reducing transfer duties and able to execute the requirement. I have just purchased the property and paid transfer duties and it will not be feasible to do this all over again and pay the transfer fees especially if the is legal.

My ex owes me a bunch of money - my mother paid her tuition and she signed a student loan with her, I signed surety. She signed a separate agreement with me saying she'll pay me back for all the money I spent. She is now 6 months behind in payments and I am drowning in her debt.
