Greetings I need help with an unfair dismissal case. CCMA forced a settlement that I signed which only benefited the company but not myself (there was misrepresentation). I’ve been debarred and reds listed (the procedures were not followed). I’ve lost a lot of opportunities in high roles due to the debarment and reds listing. Regards
I have signed a contract for a loan with lins finance loans but have not received the funds yet, although the contract states after i pay the fees i will get the loan within 30 minutes its been 5 days and still have not received the money yet so I want to sue them for fraud and breach of contract The loan amount was for R40 the fees was roughly R
Last year on the 18th July I was wrongfully arrested of rape and murder ..I was working as a general worker at construction company under municipal tender I was not given a chance to explain my self no interrogation was made I was told that I have killed and raped ..I was charged and later on the 20 July I was joined by 3 unknown males they said they are my co accused on the matter..now the matter is withdrawn but it was dropped ..I am % sure that I am innocent I know nothing about that case ..please I need your assistance
We have signed a 12 month lease agreement, now 6 months in the agreement the landlord wants us to vacate. In the contract it states that incase of the landlord selling we are to vacate and 30 notice is to be given. We have now received that notice, but upon signing this agreement in the beginning the landlord stated that it's not valid to us. Also we didn't need to pay a deposit. I need advice on how to firmly deal with this as it seems like the landlord has done this before to previous tenants and that his basically trying to force us out.
We were unfairly dismissed by Riviera On Vaal Hotel and Country Club in December while under Covid-19 Lockdown.We were 51 and all members of ECCAWUSA which was then our workers union.Our case started at Vereeniging CCMA in and proceeded to Johannesburg Labour Court.Along the way our union lost their certificate and they didn't notify us.Then last year when they were approached by the shopstewards about the progress of our case that's whereby they gave them the case number number.The shopsteward did a follow up of the case at Labour Law and discovered that the union did not submit some important documents that were needed for the Labour Court to proceed with our case.When they were asked about this matter they decided to hand-over our case files to the shopsteward.From last year up until now the shopstewards have submitted all the relevant missing documentsat the Labour Court and applied for a court hearing date.So we are waiting for a respond from the Labour Court.As shopsteward we though we can represent our case at the Labour Court to be told that we don't qualify.We are looking for someone who is qualified to represent us.Some of our members were hired by the so-called New Owner under new contracts.But the majority of them were not hired.We didn't receive any compensation from our employer for terminating all our contracts.
There is a zimbabwean guy who called me to travel from Capetown to witbank together with my family to work in his company since last year April up to now and he promise me to pay me rands but since he just pay me and now he chase me away and now l don't have anything to survive with my family
I was dismissed for not attending arbitration of an employee that dismissed before I was employed and not made aware of the case by the employer. I only received a call from the union rep on the day of the sitting 22 April and he informed me that he has send me the notice on the 30 March . The charge from employer says I received CCMA communication from the CCMA self which is not.
Has my son who applied for a Permanent Residence Permit and was declined end of October for the reason that Home Affairs suspected my PR as based on a marriage with a South African citizen was a marriage of convince. Approached a lawyer who prepared a Motion Notice and filed it with the Pretoria High Court appealing the PR decline outcome early November . The lawyer has not moved to submit Founding Affidavits and is stalling the process, hence want to change the lawyer and get another to take over the PR appeal case forward to Founding Affidavits and beyond as an PR appeal.
Good day, I trust you are well. I need to find out if the situation I am currently dealing with... if I have a case... I am a 40 year old mother of 3, I am married, I started studying through a college in Durban in the beginning of this year. The owner of the college told me I will get so much learning and knowledge in just 6 months, that is why the monthly installment is so high because of the training, knowledge and experience you get. I am supposed to do my trade test in July... I started in February and for the first 4 Mondays in February things went well. I then noticed a definite decrease in training and learning... The owner of the college also runs 2x salons and a ministry so she is always very busy... she also helps kids who are involved in drugs etc to help reform them she gives them a job in her salon... to try lead them out of negative lives etc... So as the time passed, I got less and less training and learning and practical experience etc by the end of April I was starting to get very upset, paying so much money and not getting what was promised to me... Each time I went there I was doing everything other than what I was paying to get... I was running around in my car, my fuel running errands for her, giving her clients lifts HOME to Durban CBD... other times driving around the whole day fetching people, her daughter and grand kids... by this stage i was getting very angry... I have tried to talk to her and explain i need to learn hairdressing not do all the things i have been doing for her. After speaking to her about that nothing changed... then i heard she was going overseas for 3 weeks... I was furious ... so close to July when i am supposed to do my trade test and we've hardly covered any aspects of the trade test... When i ask her if the trade test is definitely in July as promised by her, she says "that's how it looks but no guarantees "... I have paid R so far... she is refusing to pay my money back... please advise
I visited the BP station located at Morninghill to refuel my car. During this visit, I also asked the attendant to fill water in my coolant water container. However, the employee who assisted me neglected to secure the water pump bottle after filling it. As a result, the bottle remained open, causing the cooling system to malfunction and leading to my car overheating and got damaged. I want the garage to pay the money i spent on repairs.
