I have a court order for maintenance, it has not been honoured by the plaintiff. I have had many cases reporting it to the maintenance court, they have tried serve him to call him to court unsuccessfully, sheriff not able to deliver the summons. He claimed he lost his job, he is now working and also has a new company registered under his name. He was once garnished but has defaulted on payments for over 5 years. I need to have his employer served to process a garnish order. To recover the arrears and continue to pay what is due. My case and file sits at the children's Court in Johannesburg CBD. I am struggling with school fees, and supporting our daughter's needs while he just continues to live his life.
The divorce was final and decree issued. It was an uncontested divorce done through clientele legal. When i to clientele that my ex husband is contracening the 2 sections of settlement agreement, I was told I need to find a lawyer as clientele can't help. I subsequently cancelled my policy but they still debit my account.
