Two individuals purchased an apartment together, with one of them residing overseas. The property is under one of the individuals names and therefore there are potential donations tax implications that need to be considered, and we would like guidance on the most appropriate way to proceed. We are also looking to determine a realistic selling price for the property in order to evaluate the available options and resolve the matter efficiently. Could we please arrange a consultation with a conveyancing attorney to discuss the donations tax implications, the property's potential market value, and the best steps to take moving forward? We would appreciate your advice on the legal and tax considerations involved, as well as any recommendations for structuring the transaction in the most practical and cost-effective manner. Thank you.

  • What issue will the case address?: Divorce
  • Price estimate: R50,000

I got divorced in March . We were married in COP. We both had attorneys for the divorce. The agreement was that we obtain the divorce and deal with the division afterwards. I tried to follow all the steps to get this done but my ex is not cooperating. The division has not been done despite me trying for all these years, as my ex is avoiding me and the liquidators. My ex has been avoiding the liquidator’s emails, phone calls and text messages for over a year. The liquidator resigned from her duties. My attorneys stepped down once the divorce took place. I’ve recently learned that they’ve also stuffed up as the pension is not even mentioned in the divorce papers. Both my ex and I are entitled to half of each other’s pension/provident funds as per COP. I tried to claim from my ex’s provident fund but was unsuccessful as the paperwork doesn’t even mention pension or provident funds. My instructions to my then attorneys have always been complete and fair division of everything, including pension funds. I don’t know what else to do to help myself. My ex has since even sold a vehicle without my knowledge and consent and illegally tried to sell 1 of the properties with a fraudulent signature where mine is supposed to be. I was copied in the emails by mistake and thus found out about it and stopped the sale. he has been depriving me of absolutely everything and he’s even been getting rental income out of 1 of the properties without giving me any share. He currently lives in the marital home with his girlfriend and the girlfriend has even removed some of the items from the house which belongs to the estate. There are 3 properties in total. We have 4 children and he stopped paying maintenance years ago. 3 of the kids now live with him since , and I allowed this because I’ve been unemployed and unable to take care of them financially. He was paying about R maintenance only and eventually stopped paying completely without warning. I have also learned that he hasn’t been paying the full bond repayment amounts for 2 of the properties.. the 3rd property is paid up. The bond repayment for the matrimonial home is very little and he lives there with his girlfriend who owns a business… and he has a very good leadership role at the Nelson Mandela Bay Municipality and he earns a very good salary. 2 of the properties has tenants. I don’t even know who the tenants are as I haven’t seen or signed and lease agreements. I need help please.

Consultation with labour lawyer

I am seeking legal advice regarding an employment dispute involving an alleged salary overpayment and a possible allegation of dishonesty or breach of trust by my employer. I was originally employed as a Customer Service Expert. I later acted in a Team Leader role and received the applicable acting allowance. When the acting role ended in January, the acting allowance ceased, and I reverted to my normal salary for February, March, April and May. In June, I noticed that my salary had increased unexpectedly. I discussed this with my line manager, and we both considered that it might be an administrative error. However, no action was taken at the time, and the salary continued to be paid. The increased salary also appeared on the company's official BMS system. The following month, my annual ASR increase was applied to the higher salary amount, increasing it further. This reinforced my belief that the salary had been verified and approved by the company. The salary remained reflected on the official company systems for several months. Thereafter, I applied for and was appointed to a permanent Team Leader position. I received and signed a promotion contract reflecting a salary of R19,, which was calculated from the salary already reflected on the company's systems. I have now been working under this contract for approximately five months. Recently, HR informed me that the earlier salary increase was allegedly an error. They have indicated that they may reduce my salary and recover the alleged overpayments. During discussions, concerns were also raised regarding dishonesty, breach of trust, and an alleged failure on my part to report the increase. My concern is that although I did discuss the increase with my line manager when I first noticed it, this conversation took place verbally and I do not have written proof of it. I am therefore concerned that the company may attempt to rely on this lack of written evidence to allege dishonesty or a breach of my duty of good faith. I would appreciate advice on the following: Whether the company may lawfully reduce my current salary after I signed and accepted a promotion contract reflecting the higher salary. Whether the company may recover the alleged overpayments under these circumstances. Whether the facts support a potential allegation of dishonesty or breach of trust. What rights and protections I have under South African labour law. What steps I should take to protect my position should disciplinary action be pursued.

Child custody legal representation

  • City (or suburb) where you need the service: Port Elizabeth
  • What are you looking for?: Representation in court
  • What issue will the case address?: Child custody
  • Price estimate: R50,000

I fighting a full custody for my daughter which I'm supporting with everything since she was born. Her mother and I were in a relationship and broke. I went to family advocate office for assistance to get an equal right as a mother but could not come into agreement and the matter was referred to Motherwell court for assessment. Whilst we were busy with the process the mother passed away. I'm the only parent that is left but my daughter stays with her aunt and siblings. They don't want to give me the full custody of the child. I have attached the documents for their reasons not to give me the child. All the points are not true and their opposing arguments are not correct. They brought their own lawyer hence I want to be presented by a lawyer too. My daughter is 8 years old. I pay maintenance, school fees, school transport and clothes for her. Aunts are not doing anything for her. The social worker recommendations favour the father but they don't want to accept that.
