Consultation with corporate lawyer

  • City (or suburb) where you need the service: Brackenfell, Cape Town
  • What are you looking for?: Consultation
  • Price estimate: R3500

We bought a vehicle on 1 July from a registered motor dealer. The car started having problems after two weeks and would not start. We pressured the dealer into fixing the problem. After 11 days of phone calls, they finally came to collect the car and provided us with a courtesy car. The injectors of the car were found to be faulty. They did not replace the injectors with new ones and simply sent the old injectors away to be repaired. On 9 August, they were supposed to bring the car back to us, but they were involved in an accident while the vehicle was in their possession. The accident damaged the car's side panel and left-side door. The car was finally returned to us on 5 September. The side panel that had been damaged in the accident had still not been repaired. The dealer said that they were going to have Ford replace the side panel. When we got home, after having the car for approximately 30 minutes, we noticed that it had a diesel leak. We contacted the dealer again, and they instructed us to take the car to our local mechanic. They couriered another injector to our mechanic to replace the injector that was causing the diesel leak. However, this caused even more problems. The car now makes a noise when being driven and has a misfire while driving. The injector they sent was also not new but was another old injector. Our calls to the dealer regarding the matter have been ignored and have gone unanswered. We have requested on numerous occasions over the past three months that the owner contact us, but he has made no effort to do so. The dealer also refuses to provide us with his contact number. We do not know where to go from here. The car is our only means of transportation, and I have to drive approximately 90 km a day to get my children to school. And that's not all. The dealer advertised the car as being fully serviced. However, the vehicle did not come with a service book. We have been asking for the service book for three months and have received no response. We have only received empty promises that it will be couriered to us. The car's towbar has also been missing from the start. We were promised that it would be couriered to us, but we have still not received it. No effort has been made by the dealer to replace the damaged side panel. We were also forced to report the dealer to MFC Nedbank because the trade-in vehicle was never settled by the dealer. The instalment on the trade-in vehicle was deducted from our bank account in July and August and was only settled by the dealer on 5 September. We informed the dealer throughout the past month that the settlement had not been made, but they only settled the vehicle after being contacted by Nedbank. We do not know what to do from here. The dealer informed us that if they came to collect the car again, they would not provide us with another courtesy car. We do not have any other form of transportation. The vehicle is essential for our daily lives, particularly because I have to travel approximately 90 km every day to transport my children to school. We need assistance in resolving this matter and would like to know what our rights are and what steps we should take next. We have told the dealer that we want to return the car.
