Good day, I require assistance with a dispute involving a BMW d purchased from a private seller in November under a voetstoots clause. The seller misrepresented multiple material facts. He claimed he owned the vehicle for “a few months” (he owned it for less than one month), stated the battery was in good condition (it was not), and insisted the vehicle had no issues. Within ±15 km of taking ownership, the car went into limp mode with drivetrain errors, shuddering, rough idling, and cutting off. Diagnostic tests revealed fault codes P, P, P, and P, indicating pre-existing defects. We have now obtained the DEKRA report, which shows that the mileage was tampered with and the vehicle’s condition contradicts the seller’s claims. This constitutes fraudulent misrepresentation and voids the voetstoots clause entirely. The seller refuses accountability and told us to “go the legal route.” I require a formal letter seeking cancellation of the sale and/or damages, and guidance on next steps.
