Married for 37 years, three adult children. Married in community of property. Husband Director of company and has shares and four house only one bonded. Since Monday, there has been a loud vibrating/clanking noise coming from the roof space whenever water is flowing. I got divorced in March . We were married in COP. We both had attorneys for the divorce. The agreement was that we obtain the divorce and deal with the division afterwards. I tried to follow all the steps to get this done but my ex is not cooperating. The division has not been done despite me trying for all these years, as my ex is avoiding me and the liquidators. My ex has been avoiding the liquidator’s emails, phone calls and text messages for over a year. The liquidator resigned from her duties. My attorneys stepped down once the divorce took place. I’ve recently learned that they’ve also stuffed up as the pension is not even mentioned in the divorce papers. Both my ex and I are entitled to half of each other’s pension/provident funds as per COP. I tried to claim from my ex’s provident fund but was unsuccessful as the paperwork doesn’t even mention pension or provident funds. My instructions to my then attorneys have always been complete and fair division of everything, including pension funds. I don’t know what else to do to help myself. My ex has since even sold a vehicle without my knowledge and consent and illegally tried to sell 1 of the properties with a fraudulent signature where mine is supposed to be. I was copied in the emails by mistake and thus found out about it and stopped the sale. he has been depriving me of absolutely everything and he’s even been getting rental income out of 1 of the properties without giving me any share. He currently lives in the marital home with his girlfriend and the girlfriend has even removed some of the items from the house which belongs to the estate. There are 3 properties in total. We have 4 children and he stopped paying maintenance years ago. 3 of the kids now live with him since , and I allowed this because I’ve been unemployed and unable to take care of them financially. He was paying about R maintenance only and eventually stopped paying completely without warning. I have also learned that he hasn’t been paying the full bond repayment amounts for 2 of the properties.. the 3rd property is paid up.
