I registered at Master Of High Court on 21 September and there is a person who claims to be my Uncle as brother of my late Mother. The owner of the property is my late Grandfather a father of my late Mother. On this matter the person who claims to be my Uncle as a son of my late Grandfather he lies and making more arguements lying that my late Grandfather had 7 children and there is no proof but he said he had the Will that got my mother written on it. So my husband inherited a 50% share of a property . We have not lived there in 4years and before we moved out we paid then rent to the value of for the time we stayed there before renting else where and paid the utilities up. Husband and his brother have joint share and the brother agreed to sell his share to husband . But when the bond was pre approved and husband took the otp to them they have now refused and are not in a position to buy him out. He has already sent them a letter of demand and they have to responded to it. We would like to get this behind us so we can move forward. Utilities are in arrears and water is currently off.
recently bght a house and the agent never explained to me about the property having a registered and an uregistered servitudes. The registered servitude is situated where it will pose a structural risk to my property and the Home Owner Association keep on presurising me to agree with the neighbour using the servitude. I need them to register my right to cliam as the owner of the property to hold the user of the servitude liable if later I experience problems with the structure of my house.
Hi, I need advice/assistance with a sectional title dispute. The owner in the unit above me had a major repair done to her bathroom, approximately 2 months ago. The plumbers are not certified and did not offer her a guarantee for the work done (by her admittance last week). On 29 January , I informed the owner upstairs that there was water leaking from her bathroom, into my bathroom. After numerous follow ups from my side, she eventually called the same plumber for a quick repair job. A few days later, the leak started again, but worse. I've been very patient and cooperative, to the point that I even arranged for the Complex's Plumber PLUS an independent (Certified Plumbing and Building) Contractor to assess the damage and quote her for repairs. The water leakage is getting worse, damaging my bathroom tiles, and is spreading to my bedroom ceiling, with the potential of mold growth. This is devaluing my property and causing me immense stress. I have informed her of this, yet she is in no haste to get the repairs done, EVEN AFTER the plumber's assessment (severe water leakage, damage and mold already forming in her own bathroom). I have all the correspondence between myself and the owner, with images. PLEASE HELP ME. What should I do?

She wants R, for the house but I only qualify for R, I can maybe put an extra R20, but then I dont have money to pay the conveyancers for the paper work and deeds offices. Agent presented an OTP, did not explain any of the clauses in the contract besides saying it’s for banks approval for the bond and a legal binding document and nothing else. She gave us 46 pages, showed us where to sign in less than 30 minutes we than left. We were first home buyers, based on this property and unknown costs, we advised them that we can’t proceed than they pull the OTP that clauses we were not even aware of. Agent invited us to the property for signing stated that it’s a lot of pages and she has printed out all the documents. Now we were advised to reconsider or we are now liable to pay R99 .
A developer held the keys for the house was newly build claiming that I owe them and now the bank assisted with the sale of the house but there is a shortfall of then the bank offered 50% discount meaning the other 50 % must come from me. So I want to link this debt to the developer demanding them to pay as it's unreasonable to hold the keys for compared to the debt of because of so much little money .
