I was in GDE POST I found out month after that my previous district had blacklisted me ,never attended any hearing or informed about this .I thought my contract ended in December yet I was paid on January and February ..but when I enquired through phone call .. the hr also confirmed that he only see December payment no January and February
I have started a new job. My previous employer is paying out my days that I worked but are deducting leave days that they say I have used to much. I started their in 31st October and ended 11 September . I worked 6 days a week and had 18 days of leave per year. My first year I took 14 days. My second year I took 11 days. According to me I had 4 days left but now they are saying my leave is per financial year,but my contract says per completion of service over 12 months which I believe is everything 31st of October but now they are saying the leave I was entitled to is from 1st of march until the 28th of February.
I have resigned at my work and have almost 52 leave days.According to their clause it says I must take at least 10 days per annum. I have worked there 2 years and 11 months now they are saying the leave they can pay is only 18 days, I feel it is not correct because at minimum I should get +_36 after they have forfeited. On a worst case scenario I should be getting leave pay of 32 days based on the fact that I get 24 days per year

I need advice on how to go about it, it is a terrible working environment and I have just gone through a hearing where a personally related (through marriage to my family member) employee shared private voice messages she took off a chat and used it against me in a grievance.
My case is on Tuesday 11 I clock in Johannesburg room . About two weeks ago on a Friday my manager gave me a third warning in a week. I refused to sign the warning. Then the following day Saturday I went in like normal I ask the two staff that was under me to assist me otherwise the manager is coming against me again and they refused to listen to me. I then went to my manager Jonathan and asked him an I get help please, a few times and was not given help. After a few times of asking help and refusal of help I then said to him that I cannot work like this and that I am going to take this matter further and higher. And I walked out. On Monday I was back at work to do my Job Keep in mind that previous week I was threatened that Willem will fill my position. I was according to them the floor fireman. Then on a Monday I went to work to do my work. Nobody spoke to me and I did the same thing. After prayer by JJ, I went to start doing my job Willem started to do what I was supposed to do. Not to cause a scene the went and looked for something to do and found that the zinc was still on the floor and started to move that into the shelve. Jonathan came down to where I was busy working and said I am not fair. I can not walk out on Saturday and say do that I am going to take this further and higher and come back on Monday acting as if every thing is ok I can not be here. I said excuse me he said I need to tell him how I am going to take this matter further. I said that all he has to know is I am going to take this further I need to tell him. What do I mean by that I am saying I am definitely going through take it further. I am not allowed to be here then I aid okay and eft the premises I was constantly bullied by Jonathan there we ocatcre times I have told him that he is forcing me to resign. There were on 2 times that the bosses wife had to step in to calm the situation so that work can continue I was assigned as floor manager I received R per day, I have a forklift licence obtained while I worked there as it is compulsory so that I have Iicemce. I am asked mg help I was under pay far beneath what I was supposed to get I also went to the Dept of labour and they did not register me with the As they deducted uif every week . No Provident fund was deducted as well aid over to them which is mandatory law by Minister of labour On Saturdays no time and a half and public holidays double earnings. I had a hearing on that Friday no notification indicating that I have hearing a prepare my case was not really listened to . Could not comrtely state my case I want to get which is rightfully mine. They have more then on company and they underpay All . Please can someone assist me with my case. It s The 7th of October at 11 I clock in Johannesburg.
I believe I was unfairly dismissed because my employer has not been consistent in their application of discipline. I have documentary evidence since I was a HR officer chairing disciplinary hearings at work. Now, I want to be represented at the Bargaining Council of Civil Engineering Industry because the person who chaired my disciplinary hearing is a Labour lawyer.
I communicated with a senior council who advised that I shoud get an attorney to brief him on a matter that I need Concourt representation to appeal a S17(2)(f) ruling of the President of the SCA. I have demonstrated on my s17(2)(f) application exceptional facts that shows that the court aquo has breached sb of the LRA by making judgement based on non existent facts. Furthermore, the court aquo ignored my testimony that the employer execised unfair labour practise and breached s clause8 of schedule8 (1)(e)(i). I am unemployed and would seek representation on a probono basis or on a contingency fee agreement. The court aquo and the SCA violated my constitutional rights provided for in the Bill of Rights in s23 and s33 of the constitution, for me to be subjected to a fair labour practise as I was assessed over a period where I was not provided working facilities. The infringement of sb violates my rights to a just administrative action under s33. Attached hereto, is the judgement I seek to appeal.
