Hi. I have had 3 absenteeism counseling sessions with my employer. The last one was on 4th May . Today I was invited to intermittent sick absence enquiry. I fear that they are trying to dismiss me constructively. They are threatening to dismiss me and that I have to make alternative arrangements in the events where my children fall I'll. I'm basically being bullied and victimized. It took them 3 months to invite me to an enquiry. What makes me paranoid is that they wanted employees to sign fire extinguisher training that I refused to sign because I didn't get training. Now it feels they are chasing me. I resigned on 1 August and worked my notice. At the end of week 3, I was informed that I had sufficiently completed my handover and that I may finish now. I asked who I could clarify my leave due, as the leave balance was removed from my monthly payslip, and was told by the Chief of Staff. I had a screenshot of my leave applications, and calculated the leave due based on my contract. I took it over to her to acknowledge, as well as that I am not required to work full notice, but that I will be paid for the full notice period. At that point,, management called me into the boardroom and started to tell me that that is not the leave amount due, as they had reviewed my 20months timesheets and they found that I have taken 45 days personal time. I did not agree, as I knew that my timesheets were always diligently completed, and that I have definately work more than my normal hours, not less. I refused to go into what they referred to as a negotiation, and said that they are not reviewing the time correctly, and besides have not used the opportunity monthly to address any time concerns when timesheets were reviewed, which is on them. They refered to a leave policy which were introduced in the beginning of the year, which I sought clarification on, seeing that I was not allowed to take leave in December, as everyone else was, and me and my fellow new commer had to alternate during scelaton staff period, as well as upon our return we were informed due to the amount of projects no one can take leave for the forseeable future. Heidi assured me at the time, that the policy steps into effect from the 2nd leave term seeing that one must 1st accrue leave. The following Tuesday, I had to go in again, upon which the Owner Elsje maintained that the calculations were accurate, and that they do not owe me leave, and that she will share the recon for my review. I did so and found that there were several disrepancies, which I stated in a letter sent to them on 29 August. I have received only my August notice salary pay, nothing additional. I send 2 follow-up emails since, without any response to the letter in question, only received my Certificate of service and August Payslip. Please review my letter, and advice what a consultation and letter to the company cost me.

I have emigrated from Yugoslavia-Serbia to South Africa in , hoping for a better life. It was hard, since I didn’t have anybody there, but I was hoping that, on the end, reward is waiting. Time was passing, struggle continued, and I decided to try to change my life. Africa Is exotic and beautiful from many ways, so I wanted to see the continent before I leave. I went back to my parents,and I was informed by a mutual friend that Miss. Nada Rovcanin, my neighbor, wanted to go to South Africa. So I brought her over, helped with finding accommodation and started preparing a trip through Africa using my savings and pension fund. At the end of the journey, NATO started bombing Serbia, so I went back to South Africa with the idea of applying for a Canadian visa. Nada was still there, spent all the money that she brought with her, working at some restaurant, facing problems with not receiving salaries and extending her visa. Together with Mrs. Ernestine Holloway, who lives currently in the Netherlands, they put pressure on the restaurant owner to take over the restaurant, but they didn’t have enough money. My plans were changed since I get the opportunity to register for M-tech and solve some differences between my overseas and local education systems, so I decided to help Nada in creating a new life by paying for the restaurant with the rest of the pension money I had left after travelling, and sorting out her visa problem through marriage. We lived together for some time already. Mrs. Ernestine Holloway wrote by hand instructions on what should be paid to whom, and stated that I am the sole owner of Rochella's restaurant. That is the only original document that I have left; others are swapped for copies. I also have a bank statement with the transfer as per instructions. My life was between studies in Pretoria and restaurant in Johannesburg. There were always problems with the money. According to her, an experienced chef, the restaurant was working just to cover expenses, including her salary; as an owner, I was working for food and petrol, and we shared accommodation. I remember that problems between us started when I refused to use my personal credit card to pay for some expenses while her mother was visiting, later she told me that she used her mother's money to pay restaurant salaries, what I mentioned to refund in divorce proposal – even not knowing did her mother bring any money, or having any proof that this has happened. She told me that she bought three flats with the money her mother brought from overseas when she visited, and I trusted her even though the Serbian police took her mother's money at the airport, including the money that my mother sent me. Nada prepared three sets of books – for sale, tax and the real ones, but I noticed that she is changing figures on those which supposed to be real. Tired from fighting both sides and obviously unable to control anything, I filed for divorce. She refused, blackmailed, cried, so I have written the final offer you have, giving everything I have and offering even more, just to come with me to the court, but she refused again. You can probably see from the divorce papers that I was alone there and from document listing assets that it was conditional – that I will give all this if she comes with me to the sheriff. Since she was threatening me with police, and communicating with somebody from TUT, I believe that there is something wrong with the asset transfer since I was never contacted or issued any document still living about meters from her mother?! I am at the age of 58 and my pension in Serbia does not look promising. I helped whenever I could, never expected or ask for any return. Now, I feel fairly humiliated that after all good energy I have spend for her to succeed in life, I came to the point that I have to look for a pension support on this way, but still hope that there is a chance for something good. I bought a puppy - they said the puppy would be registered and would receive the certificate in a month. The puppy is now 4 months and I have had to ask continuously for the certificate.
