I need assistance with a default judgment rescindment , I have the paid up letter and consent for the rescindment from the attorneys that the account was handed to. Good Day I need advice on a matter : I discovered this year that my daughter's previous school handed me over falsely and a judgement was passed etc The credit report has a judgment of R81k, I contacted the lawyers and sent all proof of payments to a total value of R76, ,these were paid while she was still at the school and were in allocated, though POP's were sent each time a payment was made. The lawyers now say once I settle the R outstanding they will issue me with a paid up letter which I can take to court to get the judgement rescinded First is it fair that I must be the one to go to court for this rescindement Secondly , I was never contacted by these lawyers ertc for collection or whatsover nor even a received a court order What recourse do I have in this matter? If I should go to court etc where does one start once I have the paid up letter , we want to purchase property etc How long does it take to get the court to rescind the judgement? Is this something I can do myself or I will need a lawyer?
The whole report from the family advocate is fabricated to suit my ex girlfriend, this could be that all are female and are speaking the same language whereas I speak a different language from them and have favored my ex girlfriend. I’m they did not consider to look at my proof nor give a chance to prove my allegations against her.
