I am looking for legal assistance regarding an unfair dismissal matter that I have referred to the CCMA. I have already attended the conciliation process, and the matter is proceeding to arbitration. I would like to consult with a labour-law attorney who can review my case and advise me on how best to present my evidence and arguments at arbitration. Briefly, I was employed by Edufocus CC as an Administrative Officer. I was dismissed for alleged misconduct, specifically gross negligence and dishonesty. I dispute the allegations and believe that the circumstances leading to my dismissal, the disciplinary process and the reasons given for my dismissal were unfair. There are a number of issues involved, including: • My employment duties and lack of formal training; • A written warning relating to alleged performance errors; • Allegations concerning leave and my reliability; • Events leading up to the disciplinary hearing; • An alleged settlement/termination agreement that I was asked to sign; • My refusal to waive my rights; • The disciplinary charges of gross negligence and dishonesty; • The circumstances surrounding my dismissal; and • The evidence I have available, including emails, WhatsApp messages, letters and voice notes.
