I would like to request a consultation regarding a maintenance matter concerning my 18-year-old daughter. Her father and I are divorced. Our daughter has now reached the age of majority, and there is currently disagreement regarding maintenance payments. Her father is financially well-resourced, whereas my financial position is significantly more limited. I recently wrote to him in an attempt to address the situation amicably. He has demanded that I pay a specific amount of maintenance, which I am not in a position to afford. I have, however, calculated an amount that I can reasonably and sustainably contribute. Acting in good faith, I opened a separate bank account in our daughter’s name and paid my contribution directly into her account. He is now insisting that I pay the amount directly to him instead and is attempting to dictate the terms unilaterally. Given our history, this is not the first time we have faced a similar dispute. Previously, after initial demands, the matter ultimately resulted in negotiation. I am not refusing to contribute, but I will also not be bullied into agreeing to an amount I cannot sustain or into arrangements that are not legally appropriate. I would like clarity on the following: My legal obligations toward an 18-year-old child. Whether payment directly into my daughter’s bank account is legally appropriate. Whether he has the legal standing to demand payment to himself. The correct legal process should this dispute escalate. I am prepared to pay for a formal consultation and would appreciate your guidance on how best to proceed in a firm, legally sound manner.

Hi. I am also navigating a maintenance order. There are 4 protection orders pending against my ex husband and his girlfriend against my son and daughter. Criminal case was opened in cape town but the docket was sent to the Free State Fouriesburg where the insistent accused. I needing a attorney who can offer me assistance under a pro Bono case please. I am unemployed and rely on the father of out two children to pay maintenance. He currently pays our rent and data and sends between R to R a month to feed clothe our children. School Fees are not being paid, he stopped paying for my car and the medical aid. His lawyer has stated he can only afford R a month our rent is R on its own. Im representing myself but I feel I am being coerced to drop the criminal case and there are bully tactics.
