On the morning of 16th of September I was involved in a minor car accident. My vehicle was stationary & a guy reversed into me causing damage on my bumper, bonnet & components on the inside of the bonnet. Both of our license disks are expired & the guy refused to go to the police station, but said he’d take full accountability. I then proceeded to take pictures of the damage & his details. He then gave me wrong contact details because I tried calling him several time & eventually left a text message & got no response from him. I then decided to go seek video footage of the accident in order to protect myself & be able to provide evidence should he try running away. Because he had divulged where he works & I took a picture of his workplace access card, I decided to go to his workplace & couldn’t find him so I left a message with a lady that works for SAPS but she’s deployed at the presidency offices, that’s where this guy works. He then sent me a text after receiving the message, in his text he first claimed that I bumped him at the back. Little did he know I have footage. After an exchange of texts he eventually agreed to have been in the wrong & said he’d fix my car, but he disputes that he’s the one that caused the damage & he’s only willing to fix my bumper. I sent him footage & a picture of what my car looked like & he tried to find damage that is nonexistent & circled where he claims to be damage. That’s when I realized that I needed more evidence to prove my case, I took screenshots & kept all the voice notes between us, I even met with him & he tried to demonstrate that the damaged caused couldn’t have been him & claims that my car was already damaged before. I then told him that I’d find footage or pictures of my car before the accident because I had been in a security complex that has cameras to pic up a child I was dropping off at a school where this guy bumped me. His son attends the same school & barred witness & so did the security guard who tried stopping him as he reversed & I also hooted. So I went on to find footage of my car at this security complex +-45mins before he bumped me which clearly dismantled his argument. The guy still refuses & it’s been a back & forth between us till this day, hence I’m seeking legal assistance. I don’t know if this will be any help, but his son lied at school when they asked him about the accident & said that his dad paid me off. I’m happy to provide all the evidence I’ve compiled…

Good day, I would like to ask for help in taking legal action against a firm that did not provide wise counsel when we tried to get legal services. My son had a Permanent Residence Permit declined by the Department of Home Affairs last year. The decision was signed by the DG on 09 October and noted on the outcome collection on 22 October . Through a referral, we got to the Banda Law Firm in Rivonia, Johannesburg, on 24 October . The reasons for the rejections were: “According to our assessment, your father entered into a marriage of convenience with a South African citizen for the purpose of obtaining permanent residence in South Africa. Your application is premised on your father’s status as a naturalised South African citizen. Your father obtained his permanent residence and naturalisation status under questionable circumstances which therefore renders his status doubtful. In addition, it was discovered that your alleged parent, Edmore , did not indicate or mention you as being his child on his original application for Permanent Residence; therefore, the birth certificate as submitted in support of your application is questionable. You, therefore, do not qualify for permanent residence in terms of Section 27(g) of the Immigration Act. You may, within 10 working days from the date of receipt of this notice, make written representations for a review or appeal of the decision to the Director General through www.vfsglobal.com/dha/southafrica.” The detailed brief of the entire story is provided in the attached document.
The IO is colluding with the state prosecutors (District and Regional Court prosecutors) and are refusing to give us a CCTV footage for the crime scene. District Court prosecutor favored the IO and allowed the case to move over to Regional Court with missing evidence (CCTV footage). The Regional Court prosecutor has allowed a pre-trial to be conducted with missing evidence (CCTV footage. There was an arrangement for the IO to privately hand the CCTV footage over to our previous attorney, which I strongly believe that it will never happen since this footage was downloaded from the source on a day after the incident, but the IO failed to furnish the court and the defence with that on these due dates: 11 Dec , 18 Dec , 23 Dec , 30 Jan , 20 Feb , 07 March , 04 April , 08 May , 23 May , 23 July , 21 Aug , 16 Sept , 23 Sept and 14 October . It has transpired that the memory stick that was handed over to the Regional Court prosecutor by the IO is blank and has 0 bytes of information inside it. However, the IO received a CD ROM containing the entire footage from the CCTV company, and decided to copy a small portion of the CD ROM that suites him and presented that to the Regional Court prosecutor and failed to provide the same to us, the defence. Now that there is something fishy about the information/ evidence contained in the ORIGINAL CD ROM from the CCTV company, the Regional Court prosecutor is now siding with the IO and telling us that he will not be using the CCTV footage for trial, but we, the defence want it so that can check what is contained in it, and our previous attorney who colluded with the IO and the Regional Court prosecutor, while noticing that I was late on the 14th of October, since I am doing a watching brief for my nephew, decide to allow the Regional Court prosecutor to pre-trial my nephew with pending CCTV footage evidence (Pending since the 11th of Dec ). Our previous attorney failed to deliver what we agreed on, and that was to request the Magistrate to dismiss the case since the state has been wasting our time and money on attorney costs while making us wait for the CCTV camera footage. Since, I having noticed that our previous attorney would later lie and state that he did receive the footage and he is happy with it in a tampered with condition, I did not trust him anymore and requested him to withdraw. So, I hereby need an honest and trustworthy attorney who will do his proper due diligence and not collude with anyone from our opposition.

I have my kids in private school, I fell behind on fees and i have been struggling to catch up the payment. I have made arrangements and couldn’t honor them. I got retrenched from a job also making that hard. Their father pays his half (splitting between two kids! and is somewhat up to date but I am struggling between catching up rent, food and debt. I’ve even had to go under debt review. Recently started a new job. What do I do because I don’t want my kids to be suspended and I’ve made so many arrangements I didn’t honor.
