I am the tenant of a restaurant/franchise business . My commercial lease expired and has been running month-to-month. I have accumulated rental arrears and previously signed Acknowledgements of Debt (AODs) with the landlord. To settle the full debt, I concluded a signed Sale of Business Agreement with a buyer who is ready, willing, and able to take over the premises and sign a new lease with the landlord. The sale proceeds will cover all outstanding arrears in full. The landlord has refused to consent to the lease cession/transfer and instead issued a letter purporting to cancel the lease with immediate effect and demanding I vacate by 30 March which is days away. No court order has been obtained. I need urgent legal assistance with the following: 1. Challenging the validity of the cancellation notice (insufficient notice period under SA common law) 2. Defending against eviction — no court order exists and the landlord cannot self-evict 3. Father suddenly stop paying child support, promised to pay on the 20th but did not. Ignoring my mails and messages from the begging may not speak to him directly only through his girlfriend now wife. He is working for his brother P&M Skietwerke the last mail received from him was saying there was a hold up with his salary. Should pay child maintenance on the 1st of every month but pays late and most of the time must plead for the maintenance. Children where taken away from the welfare.
