Landlord withholding full deposit with claims of deep cleaning and property repair that was not brought up in the final walkthrough. Every time we contact them further, a new list of grievances appears. I am purchasing a property and the property currently has a tenant. The offer to purchase did not stipulate that there is a tenant on the property and I have requested the following from the estate agent and the transfer attorney Is there any particular reason why the transfer attorney and the agents are unwilling to draft an addendum which clearly rectifies clause10 (1) & (2) in the Offer to purchase ? Drafting this addendum would make me feel more comfortable to proceed. I am willing to make the payment and sign the transfer documents once the addendum is signed by Sellers and Buyers. The addendum should address the following: (1) Rectify the above-mentioned clause 10 (1) and (2) which previously erroneously gave an indication that there is no tenants in the property. (2)A special condition should be added stating the following.... The seller will ensure that the tenant vacated prior to transfer. The Conveyancer cannot allow transfer to take place unless he receives written confirmation from the Purchaser or Property Practitioner that the tenant has vacated" I still have not received any feedback from the attorney.

We have signed the Sale agreement for an auctined property of a late person without the letter of executorship. The sale agreement does not state that the house is for a deceased person and also they does provide us with a letter of executorship. The bank has approve the bond so we dont want to proceeds with transaction without that letter. So they are delaying us and the OTP is valid for 30 days. They want the OTPbto expire so that they can not refund us. When we do investigations this house was sold before on the8 october , they claim that the buyer defaulted. Now it was advertised with a different address by a different agent but that agent was there when we bid. The sale agreement is not valid and the missing Letter of Exedutorship. I was unjustly evicted from a property I'm renting by the landlord, immediate eviction though Im currently out of south Africa. They asked my family including a 2 years toddler and staff to vacate within 30 minutes, threatened them with police and some people the owner called bylaw officers, break doors and search rooms and personal stuff with no authorization or warrant. My people were ask to take only their clothes. Some left with no clothes because of the pressure and threats from the owner and people who where accompaning her. They had no eviction notice from the court. Someone from the rental agency brought an immediate eviction letter yesterday evening around 5pm asking my family and staff to vacate the property today 18th November. At 9am today 18th November the owner was there and gave my family 30 mins to leave. They didn't allow them to take even foodstuffs. My family is out of the house now with no alternative accommodation. They left everything behind, furniture's, beds, fridges with food, beds electronics, everything. My home office was searched, door to prayer room broken. Yes I owe them, I had to pay my rents on the 1st of November which I haven't. Will explain more when I come for consultation.
