I am seeking legal advice regarding an employment dispute involving an alleged salary overpayment and a possible allegation of dishonesty or breach of trust by my employer. I was originally employed as a Customer Service Expert. I later acted in a Team Leader role and received the applicable acting allowance. When the acting role ended in January, the acting allowance ceased, and I reverted to my normal salary for February, March, April and May. In June, I noticed that my salary had increased unexpectedly. I discussed this with my line manager, and we both considered that it might be an administrative error. However, no action was taken at the time, and the salary continued to be paid. The increased salary also appeared on the company's official BMS system. The following month, my annual ASR increase was applied to the higher salary amount, increasing it further. This reinforced my belief that the salary had been verified and approved by the company. The salary remained reflected on the official company systems for several months. Thereafter, I applied for and was appointed to a permanent Team Leader position. I received and signed a promotion contract reflecting a salary of R19,, which was calculated from the salary already reflected on the company's systems. I have now been working under this contract for approximately five months. Recently, HR informed me that the earlier salary increase was allegedly an error. They have indicated that they may reduce my salary and recover the alleged overpayments. During discussions, concerns were also raised regarding dishonesty, breach of trust, and an alleged failure on my part to report the increase. My concern is that although I did discuss the increase with my line manager when I first noticed it, this conversation took place verbally and I do not have written proof of it. I am therefore concerned that the company may attempt to rely on this lack of written evidence to allege dishonesty or a breach of my duty of good faith. I would appreciate advice on the following: Whether the company may lawfully reduce my current salary after I signed and accepted a promotion contract reflecting the higher salary. Whether the company may recover the alleged overpayments under these circumstances. Whether the facts support a potential allegation of dishonesty or breach of trust. What rights and protections I have under South African labour law. What steps I should take to protect my position should disciplinary action be pursued.
The company took one third of my pension+- thousand and gave me only thousand. As the new law of three pot system I was over 55yrs that means I could have all my money if company agreed by what they did they all other company to be my financial advisor. My fiance was arrested for possession of unlicensed fire arm, he was asked to help a orderly lady to clean her 9mm because she is struggling to do it her self she is almost 70. The police stopped us and got the 9mm . I fighting a full custody for my daughter which I'm supporting with everything since she was born. Her mother and I were in a relationship and broke. I went to family advocate office for assistance to get an equal right as a mother but could not come into agreement and the matter was referred to Motherwell court for assessment. Whilst we were busy with the process the mother passed away. I'm the only parent that is left but my daughter stays with her aunt and siblings. They don't want to give me the full custody of the child. I have attached the documents for their reasons not to give me the child. All the points are not true and their opposing arguments are not correct. They brought their own lawyer hence I want to be presented by a lawyer too. My daughter is 8 years old. I pay maintenance, school fees, school transport and clothes for her. Aunts are not doing anything for her. The social worker recommendations favour the father but they don't want to accept that.
A drunk driver was speeding and hit my directly on the back if my car causes my vehicle to flip with me inside. The driver was arrested for being 5 times over the alcohol limit. My vehicle is beyond repairs. I am still oweing money on my car because it was bought on finance. I also use my vehicle to make an income so my wife and kids are directly affected. The car is visably writen off. My vehicle was only 3 years old. purchased brand new in . I even have a dekra report done once a year for income purposes. The vehicles airbags also did not deploy even though the vehicle flipped 3 times. Worse part being is myself and the drunk driver has no insurance.
I would like to find out how i can be assisted on what to do for my child to have my name on her birth certificate,i am still awaiting an outcome on my appeal permit application from the department of home affairs,my child mother's family is asking me to pay 6 cows for my child to bear my name which i find unfair,firstly I'm not with the mother anymore,secondly when we met she had a child already and her first baby daddy didn't have to pay this much for his child to bear his name.
