A conveyancer is a lawyer who specializes in the legal aspects of buying and selling real property. In South Africa, a conveyancer is required to handle the transfer of registered ownership of immovable property, ensuring that it is legally compliant with local laws and regulations. They manage the documentation and facilitate the change of title from one person to another.
The conveyancing process involves several key steps: drafting and reviewing the offer to purchase, checking the title deed and property restrictions, obtaining clearance certificates (like rates and taxes), preparing and signing transfer documents, and finally, registering the property in the new owner's name at the Deeds Office. This process ensures the transaction is legally valid.
The conveyancing process typically takes between 8 to 12 weeks from the date of sale agreement to the completion of the property transfer, assuming there are no complications. The timeframe can vary based on several factors, including the speed at which parties provide necessary documents and the efficiency of the local Deeds Office.
Conveyancer fees are regulated and are typically based on a tariff recommended by the Law Society, which is a percentage of the property value, plus VAT. These fees do not include additional costs such as Deeds Office levies and other disbursements necessary for the transfer process. It's advisable to get a detailed quote from your conveyancer to understand all associated costs.
I require the services of an effective conveyancer, who can obtain a new original title deed for RDP property in Mamelodi, re-establish a sensible Sales Agreement that honestly re-creates what was contained in the original sales agreement, obtain clearance certificates from city council, and effect transfer of ownership. I can provide more details upon request.
Conveyancer . I am in the process of finalising a divorce settlement, and as part of the agreement, my spouse will be transferring his 50% share of our jointly owned property to me. We were married in community of property, and I require a Section 45 bis(1)(a) endorsement to reflect my sole ownership of the property. Bond status: Fully paid
I am in the process of making a property purchase, that is very straight forward. The Estate agency appointed conveyancers to do the transfer, I asked them for a discount on the fees, as I have received a discount on the bond registration fees, I felt it was reasonable to ask. I was told this is usually only done for recurring clients. I would like to find out if this is true and if not, could I get quotes to potentially then switch the conveyancers.
Good day Please provide me with a quotation. My husband and I are getting a divorce and I am retaining the property and paying him out. I need a conveyancer to assist with the transfer of the property onto my name after the divorce. I have attached the COJ account. Please provide me with a detailed quotation for these services.
I need to 'remove' my late husband's name from the title deed a townhouse valued at about R,. We were married in community of property and I an the executor of the estate. I understand that no transfer duty is payable as the property is valued under R1, - and that conveyancer fees is between R1, and R3, per transaction. Please provide me with a reasonable quote (I am sick and tired of being ripped off!)
I am purchasing a property and the property currently has a tenant. The offer to purchase did not stipulate that there is a tenant on the property and I have requested the following from the estate agent and the transfer attorney Is there any particular reason why the transfer attorney and the agents are unwilling to draft an addendum which clearly rectifies clause10 (1) & (2) in the Offer to purchase ? Drafting this addendum would make me feel more comfortable to proceed. I am willing to make the payment and sign the transfer documents once the addendum is signed by Sellers and Buyers. The addendum should address the following: (1) Rectify the above-mentioned clause 10 (1) and (2) which previously erroneously gave an indication that there is no tenants in the property. (2)A special condition should be added stating the following.... The seller will ensure that the tenant vacated prior to transfer. The Conveyancer cannot allow transfer to take place unless he receives written confirmation from the Purchaser or Property Practitioner that the tenant has vacated" I still have not received any feedback from the attorney.

Dear Sir/Madam, I am seeking the assistance of a conveyancer to issue a Conveyancer’s Certificate required by the City of Cape Town in support of a Land Use Management application in terms of Section 42(g) of the Municipal Planning By-law. The certificate is required to confirm the restrictive title deed conditions applicable to the property and to specify which conditions are to be amended or removed.

Hello.. I need help. My child was knocked by a car. And the driver was drunk. They even took her from the scene to the clinic without informing the police first. I went to the police station to check if the case was opened. No one there is willing to tell me anything. They even refused to do a breathalyzer test. On him. They took him from the clinic straight to his home. I am still at the station. They are even refusing me to talk to the station commander. What steps should I take. The child is at klerksdorp hospital now. The driver was also under influence of alcohol.
