I am purchasing a property and the property currently has a tenant. The offer to purchase did not stipulate that there is a tenant on the property and I have requested the following from the estate agent and the transfer attorney Is there any particular reason why the transfer attorney and the agents are unwilling to draft an addendum which clearly rectifies clause10 (1) & (2) in the Offer to purchase ? Drafting this addendum would make me feel more comfortable to proceed. I am willing to make the payment and sign the transfer documents once the addendum is signed by Sellers and Buyers. The addendum should address the following: (1) Rectify the above-mentioned clause 10 (1) and (2) which previously erroneously gave an indication that there is no tenants in the property. (2)A special condition should be added stating the following.... The seller will ensure that the tenant vacated prior to transfer. The Conveyancer cannot allow transfer to take place unless he receives written confirmation from the Purchaser or Property Practitioner that the tenant has vacated" I still have not received any feedback from the attorney.

We have signed the Sale agreement for an auctined property of a late person without the letter of executorship. The sale agreement does not state that the house is for a deceased person and also they does provide us with a letter of executorship. The bank has approve the bond so we dont want to proceeds with transaction without that letter. So they are delaying us and the OTP is valid for 30 days. They want the OTPbto expire so that they can not refund us. When we do investigations this house was sold before on the8 october , they claim that the buyer defaulted. Now it was advertised with a different address by a different agent but that agent was there when we bid. The sale agreement is not valid and the missing Letter of Exedutorship. We want assistance to get our money back.

I have received two emails from an owner in the same sectional title scheme which are intimidating, threatening and arguably sent on the premise of inciting political hatred. We started off the divorce process as a DIY, it is uncontested and very straight forward but there are 3 minor children. The family advocate rejected our application, stating it was not in the best interest of the children but we are happy to change it to whatever it needs to be to get it finalized. I am in a Section process that appears unlawful. The company refuses to give any of the financial documents required for meaningful consultation.
